The Health and Safety Executive (HSE) welcomes the Health and Safety (Offences) Act 2008 which received Royal Assent yesterday (16 October 2008). Welcoming the announcement, HSE Chair Judith Hackitt said: "The new Act sends out an important message to those who flout the law. However, good employers and good managers have nothing to fear. In fact, they have much to gain. "I want to remind businesses that there are no changes to their existing legal duties and that important safeguards are in place to ensure these new powers will be used sensibly and proportionately."Our enforcement policy targets those who cut corners, gain commercial advantage over competitors by failing to comply with health and safety law and who put workers and the public at risk." Achieving ISO14001:2004 standards set by the BSi can be an arduous task and almost impossible if you do not have the expertise and guidance from a professional. Many organisations are not in a position to have qualified staff to take them seamlessly through to certification stage.

Anglo Dutch Company Visser & Smit Hanab (UK) Ltd found they were in just that position and decided to call upon the services of she ltd. Kevin Jones, director of she ltd, is an experienced consultant within the safety, health and environmental disciplines. she ltd work with companies of varying sizes both in and around Northamptonshire.

The reality

Health and safety law is often used as an excuse to stop children taking part in exciting activities, but well-managed risk is good for them. It engages their imagination, helps them learn and even teaches them to manage risks for themselves in the future. They won’t understand about risk if they’re wrapped in cotton wool.

Risk itself won’t damage children, but ill-managed and overprotective actions could!

Death fall - firms fined

Two firms are fined £130k

Maidstone Crown Court heard, on 30 October, that the workman had been fitting floor gratings around three newly installed boilers, at a new facility for converting waste to energy, when the incident occurred on 19 July 2005. Many of the floor gratings were not correctly secured, while others had been displaced by pipe fitters. This resulted in one of the displaced gratings giving way, causing the workman to fall 23 metres to his death

The principal contractor, Lentjes UL Ltd, pleaded guilty under section 3(1) of the HSWA 1974 and was fined £45,000, with costs of £25,000. Rafako S.A. was sub-contracted to install the boilers and pleaded guilty to breaching regulation 6(3) of the Work at Height Regulations 2005. The firm was fined £85,000 and ordered to pay costs of £35,000.

Underfunded HSE

The unions have attacked the government over it's funding of the HSE. A report suggests that major injury investigations have decreased by 43-per-cent between 2001 and 2007. It also reveals that there has been a 69-per-cent reduction in the number of ‘over three-day’ injuries investigated, and a 31-per-cent fall in ‘dangerous occurrences’ investigations.

The trade union believes the reduction in investigations is due to a lack of resources in the HSE rather than a decrease in the number of incidents reported. The group is now demanding the Government provides extra funding to allow the HSE to employ additional inspectors to handle the need for investigation.

Dear All

For those who have not been in Kettering over the last few days, I am very pleased to advise you that subject to the LRQA Technical Review, Visser and Smit Hanab (UK) Ltd will be awarded theLRQA BS EN 14001 Environmental Management Systems (EMS) certification in the next few weeks.

We have over the last three days gone through our stage two audit, and have come through it with only a few minor non conformities and a few findings relating to the EMS that has been worked on over the last year and a bit, we have already made many improvements in the last three months when we underwent the first stage audit.

I would like to thank everyone who has helped with any part of the EMS, from the onsite toolbox talks and training that they undertook through to the audit sites, both Kettering and Gunfleet Sands, without your input and help we would not have achieved this second stage.

Kevin Jones from SHE Ltd, who has lead us through the many internal and external audits and who has produced the overall EMS package, has asked me to also thank you all as well, I would like to on behalf of everyone at Visser and Smit Hanab (UK) Ltd say a big thank you to Kevin and to Mike of SHE Ltd for all that they have done to get us through to certification. The Berkshire rail crash has been described as a "tragic accident" by the government after a report found no fault with rail equipment or staff. Transport Secretary Alistair Darling said "we owe it to those who were involved" to find out what happened.

What is asbestos?

Asbestos is a naturally occurring fibrous material that has been a popular building material since the 1950s. It is used as an insulator (to keep in heat and keep out cold), has good fire protection properties and protects against corrosion. Because asbestos is often mixed with another material, it's hard to know if you're working with it or not. But, if you work in a building built before the year 2000, it's likely that some parts of the building will contain asbestos. HSE launches 'Asbestos: The Hidden Killer' campaign

Figures issued by the Health and Safety Executive today revealed that every week 20 tradesmen die from asbestos-related diseases, and this number is set to increase. Former tradesman and England and Arsenal footballing legend, Ian Wright, has given his support to help highlight the importance of the Health and Safety Executive's (HSE) "Asbestos:The Hidden Killer" campaign which is running throughout October and November and aims to reduce the rising death rate by educating today's tradesmen about the danger that asbestos presents to them. EU leaders will maintain their targets and timetable for tackling climate change, despite objections from some nations, the French president has said. At a summit in Brussels, Nicolas Sarkozy said "solutions" would be found for those that had expressed concerns.

UK business has saved £1 billion in energy costs

The Carbon Trust has helped UK businesses save £1 billion in energy costs and cut carbon emissions by 17 million tonnes since its inception in 2001. Businesses working with the Carbon Trust cut their carbon footprint by approximately two million tonnes last year - an increase of around half a million tonnes compared to the previous year. An important part of this milestone has been the Carbon Trust’s support for smaller businesses. In 2007/08, the organisation provided £40 million of support to small and medium sized businesses. Since 2005, the Carbon Trust has helped these businesses to save almost one million tonnes of carbon and implement more than £100 million of direct cost savings. The Carbon Trust is also playing an important role in helping the UK hit its renewable energy targets. The organisation’s work in financing low carbon enterprises and developing low carbon technology is expected to deliver carbon savings of between 16.2 – 23.3 million tonnes of carbon over the next few decades. The Carbon Trust, an independent company set up by government to drive the low carbon economy in the UK, is also expanding its work internationally. The organisation has been approached by a wide range of countries keen to harness its expertise in the low carbon sector. It is currently working on partnerships in China and the US to share its experience in carbon footprinting and low carbon technology innovation.Dr Neil Bentley, Director of Business Environment at the CBI, said: ‘The Carbon Trust provides important practical advice to businesses of all sizes looking to lower their carbon emissions. The carbon and cost savings achieved by the companies the Trust has worked with demonstrate that environmental efficiency can also equate to financial efficiency in today's global marketplace. To succeed in creating a low-carbon Britain, we need to build on this work and the CBI will continue to work closely with the Carbon Trust over the coming year to help that happen’Tom Delay, Chief Executive, of the Carbon Trust said: ‘We fundamentally believe that a move to a low carbon world represents a vast commercial opportunity for businesses. Now farmers can choose from 250 ways to benefit their farm while protecting soils, water and wildlife. Fifteen real-life case studies demonstrate that what’s good for the environment makes good business sense for the farmer too.

Topics covered include effective management of soil, manures, crops and livestock to minimise adverse environmental impacts as well as using water wisely and reducing erosion. Food and drink manufacture

Up to 150 000 jobs become available each year in food processing and manufacturing activities. The majority of these jobs are thought to be filled by workers from overseas. In recent years, and in particular since 2004, many of these jobs have been filled by citizens from the new EU Member States.
As a result, there has been a significant increase in workers from Eastern European and Baltic States including, in particular, Poland, the Ukraine, the Czech and Slovak republics, Latvia, Lithuania and more recently Bulgaria and Romania.

Overseas workers are now an essential part of the UK economy and of more localised rural economies and many businesses are reliant on them to survive.

There are significant numbers of overseas workers in most of the 30 food and drink manufacturing sectors in the industry which include meat and fish processing, dairies, bakeries, fruit and vegetable processing, confectionery manufacture, chilled and frozen products and drink manufacture.

The largest proportion of injuries (over 50%) to food manufacture workers result from manual handling of heavy or awkward loads, from slips on wet or food-contaminated floors or trips over items on the floor. Other severe injuries can be caused by falls from height, machinery or workplace transport such as lift trucks or lorries.

In addition, a significant number of food manufacture workers suffer occupational ill-health, in particular, musculoskeletal injuries caused by repetitive work (eg at conveyors), occupational dermatitis, occupational asthma (eg from flour dust) and noise-induced hearing loss.

Asbestos - the hidden killer

The HSE's National campaign is starting October 2008 to target tradesmen at risk from asbestos exposure.
During October and November 2008 HSE in partnership with key stakeholders will be running a national campaign to target tradesmen (primarily plumbers, electricians, joiners as well as other tradesmen) who are still at risk from exposure to asbestos. The campaign will build on the success of the previous pilot campaign in the North West. The primary aim of the campaign is to raise awareness amongst tradesmen that they are more at risk than they think from asbestos. The campaign also aims to encourage tradesmen to find out more about asbestos and the precautions they should be taking.

The campaign comprises:
National radio adverts.
Adverts in national press
Distribution of campaign material to plumbers, electricians, joiners and other tradesmen
Case studies being developed nationally
PR activity, including the use of case studies.
Articles in trade press magazines.

Green Chemistry

What is Green Chemistry?
Green chemistry is a set of 12 principles aimed at reducing and eliminating the use and generation of hazardous materials.

This can also encompass the reduction and elimination of resources, thereby including the concepts of resource efficiency and sustainability. At Envirowise, the focus of Green Chemistry is on industrial applications, so as well as designing out waste through more efficient processes, the principles incorporate the search for less hazardous alternatives.
This is also a theme of relevance to REACH and the Defra-led Working Group on Substitution who organised the recent conference 'Successful Substitution beyond REACH' . The following are banned due to health and safety reasons (allegedly): The Mail reported an organ grinder and his toy monkey were 'banned' from busking for health and safety reasons due to no risk assessment. A Lifeboat is banned by health and safety... three hours after saving drowning schoolgirl (
The Mail - again) due to fears about the safety of the hull. The Telegraph reported that graveside flowerpots are banned from churchyard for health and safety reasons (The Telegraph), apparently the terra cotta pots or glass jars could fragment and injure gardeners, leading to the parish being sued. New legislation
Changes from the HSE from the 1st October 2008The 2nd Adaptation to Technical Progress (ATP) to the Dangerous Preparations Directive (DPD). The 2nd ATP adjusts the ‘rules’ for classifying and labelling preparations (mixtures) of chemicals based on the classification of the constituent substances and their concentrations in the preparation. It was due to enter into legal effect in EU Member States on 1 March 2007. For technical reasons we were unable to meet this deadline. Lone workers
There is no law which says that people cannot work on their own, however the Health and Safety at Work etc. Act 1974 places a duty on the employer to ensure that all work activities are carried out safely. I am a lone worker. What should I expect from my employer? A risk assessment is required under the Management of Health and Safety at Work Regulation 1999, which will look closely at how the job is done and identify the work hazards, assess the risks involved and ensure that adequate measures are put in place to avoid the person carrying out the work being harmed. Once risks have been addressed, a safe working procedure should be developed. This should contain as much relevant information as possible, both for the worker and their supervisors.What would a safe working procedure include? Checks should be carried out, for example, by regular visits of a supervisor, another employee or other designated person; or a system by which workers are required to check in at regular intervals. Where personal checks are used the duration between checks should be based on the estimated hazard of the job. Periodic telephone contact may be adequate for low risk working alone situations.Where can I find out more? New legislation from the HSE

Changes due to commence on 1 October 2008
The 2nd Adaptation to Technical Progress (ATP) to the Dangerous Preparations Directive (DPD).
The 2nd ATP adjusts the ‘rules’ for classifying and labelling preparations (mixtures) of chemicals based on the classification of the constituent substances and their concentrations in the preparation. It was due to enter into legal effect in EU Member States on 1 March 2007. For technical reasons we were unable to meet this deadline. HSE have recently completed a public consultation on proposals to implement the Directive through amendments to the Chemicals (Hazard Information and Packaging for Supply) Regulations 2002. It is expected that the new regulations will come into force on 1 October 2008.

Sir,
The recent headline ‘Small businesses advised to shun health and safety experts’ is completely wrong – the Better Regulation Executive (BRE) fully recognise the importance of health and safety assistance to small firms! What they have suggested is that ‘low risk’ small firms could consider doing more for themselves in-house, with more help from the Health and Safety Executive (HSE) and Local Authorities. And the government will obviously need to ensure there are adequate resources to provide this level of support.
The real imperative is for businesses, large or small, to get the best advice. Unfortunately, the government do not set minimum qualification levels and it’s difficult for employers to always recognise competent health and safety practitioners. So, we’re delighted to see BRE now support our call for better government guidance on ‘competence’ and indeed, have produced our own free guide for employers to help with this.
As the Chartered body for health and safety professionals, the Institution of Occupational Safety and Health (IOSH) believes the current lack of clarity about competent advice could be damaging. Not only to individuals whose lives and long-term health may be put at risk; but also to businesses acting with no or inadequate advice, leading to decisions that are either dangerous or over the top. Interestingly, recent HSE research found the top two solutions suggested for preventing any ‘over-cautious’ decisions were ‘definitive guidance’ and ‘access to professional health and safety advice’.
So, engaging properly qualified health and safety professionals is essential for employee wellbeing and for UK enterprise to flourish. Any death at work is a personal tragedy for everyone concerned and has huge economic impact too. It’s been estimated that work-related injury and illness can cost society up to a staggering £31 billion per year. We all need to do more to prevent this and find better ways of working. Business leaders, decision-makers and the workforce are entitled to be guided on when and where to get the best advice.

The reality
There have been many reports of HSE, and health and safety law, being responsible for banning all sorts of things. For example, flip flops at work, knitting in hospitals, school sports days, a charity Christmas swim and even cuddly toys on dustbin lorries.
Actually, HSE has banned very little outright, apart from a very few high-risk exceptions (e.g. asbestos which kills over 5,000 individuals a year). HSE believes that health and safety should be about taking practical steps to manage real risks, not bureaucracy leading to the banning of everyday activities.

Next time you hear of a 'ban', if in doubt check it out.

Safety Laws ban *Poles in Fire Stations

The Reality: It was widely reported that a fire station was built without the traditional pole for 'health and safety' reasons. As the county’s Chief Fire Officer said: 'Whilst every consideration regarding health and safety was taken into account, the reason a pole was not included was purely due to space restrictions.' Top Ten Tips
Writing an environmental policy statement?

Produced for the Northants Chamber of commerce: More and more of the “bigger” companies are requesting safety and environmental information from their suppliers and contractors. To help business comply with the raft of environmental legislation and to improve their environmental “credentials” here are my top ten tips for writing an environmental policy statement.

1.Look at what you do and how it “impacts” on the environment. If you use materials then these are a “resource”. Include in your statement a commitment to minimise the use of natural resources.

2.Look at what you do and how it “impacts” on the environment. If you produce waste, then include in your statement a commitment to reducing waste going to landfill through reusing, reducing and recycling.

3.Look at what you do and how it “impacts” on the environment. If you use gas and electricity then add a commitment to being more energy efficient.

4.If you have staff, include a sentence on improving staff environmental awareness by providing information, instruction and training.

5.State that you will comply with all “applicable” environmental legislation and other “appropriate” requirements (you will need to find out what these are).

6.Be honest state “At **** we realise that our activities have an impact on the environment.” If necessary include large/ small to add a bit more detail.

7.State you will “prevent pollution” this will be received well with both corporate and tree huggers!

8.Make it available to all, if you are going to put on your website, do so. If you state this in your policy statement make sure you are doing what you say you are doing.

9.Make it applicable to you and your organisation. It does not need to be “War and Peace”, make it shorter and concise.

10.Include a commitment to “continual improvement”, continual means a gradual improvement over a set period of time. Do not expect to be perfect in one month!

Lastly (and I know this could be tip 11), this is just the policy statement. The real work is the arrangements under pinning it. You do not have to have a system such as ISO14001; it can be a small internal system. As long as it works!

Welcome to this month's safety newsletter. The idea of these newsletters is to raise safety awareness and to get you involved. This month’s topic is an introduction to risk assessment.

Background
A risk assessment is an important step in protecting workers and business, as well as complying with the law. It helps to focus on the risks that really matter in the workplace – the ones with the potential to cause real harm. In many instances, straightforward measures can readily control risks, for example ensuring spillages are cleaned up promptly so people do not slip, or cupboard drawers are kept closed to ensure people do not trip. For most, that means simple, cheap and effective measures to ensure the most valuable asset - your workforce - is protected.

What is risk assessment?
A risk assessment is simply a careful examination of what, in the workplace, could cause harm to people, so that business can weigh up whether they have taken enough precautions or should do more to prevent harm. Workers and others have a right to be protected from harm caused by a failure to take reasonable control measures. The law does not expect business to eliminate all risk, however they are required to protect people as far as ‘reasonably practicable’. "Reasonably practicable" means risk vs. cost; if a safety fix is going to cost pennies to prevent a fatal accident then it is reasonably practicable to implement it. If however a safety fix is going to cost millions to save a paper cut then this would not be reasonably practicable.

How to conduct an assessment
The Health and Safety Executive recommend a five step process:
1. Identify the hazards
2. Decide who might be harmed and how
3. Evaluate the risk and decide on precautions
4. Record the findings and implement them
5. Review and update where necessary

When thinking about conducting a risk assessment the following terms are useful:
a hazard is anything that may cause harm, such as chemicals, electricity, working from ladders, an open drawer etc; the risk is the chance, high or low, that somebody could be harmed by these and other hazards, together with an indication of how serious the harm could be.

We can all do risk assessments, and we often do so without even thinking about it. Risk assessment is about applying "common sense". It is knowing what to look for and how to deal with it.
