Details of changes that are due to commence on 6 April 2010

Notification of Conventional Tower Cranes Regulations 2010
These Regulations will require certain information about conventional tower cranes used on construction sites to be notified to the Health and Safety Executive (HSE)

Biocidal Products (Amendment) Regulations 2010
These amendments will allow biocidal products containing active substances that were on the market in the EU on 14 May 2000 (and are being supported for review), to remain on the market for a further four years beyond 14 May 2010 (the current cut-off date for such products) while the European Commission completes its ongoing reviews of the active substances in those products.

Dates for HSE updates

The Health and Safety Executive (HSE) is committed to helping business and other stakeholders adapt to changes in occupational health and safety law and practice. In February 2005, HSE decided to implement changes that arise from within the UK on only two dates each year. The HSE have extended this to legislation arising from Europe, wherever it is in our control to do so. This statement lists the regulations that are due to commence on 1 October 2009 and the 6 April 2010. The HSE will update it every 6 months, covering a rolling 12-month period.

The two 'Common Commencement Dates' are:

6 April (the start of the tax year); and
1 October
By harmonising commencement dates the HSE hope that those affected (ie businesses, employee representatives and individuals) will be more aware of forthcoming changes and better able to plan for and implement new measures effectively.

The Regulatory Enforcement and Sanctions Act 2008

The Regulatory Enforcement and Sanctions Act 2008 has now been fully implemented. This provides the Environment Agency with greater flexibility to enforce environmental law, and brings their enforcement powers more in line with the HSE.

The range of new powers includes:

- Stop Notices – prevent a business from continuing to carry out an activity until steps have been taken to ensure compliance.

- Compliance Notices – a requirement to take steps within a stated period to ensure that an offence doesn’t continue or re-occur;

- Restoration Notices – an instruction to take steps to ensure that a situation is restored, so far as possible, to what it would have been if no offence has been committed;

- Enforcement Undertaking – allows businesses to take corrective action quickly without fear of further sanction for that offence.

- Fixed and variable monetary penalties.

The powers will not replace existing informal methods.

Businesses and individuals have the right to appeal a decision through an independent tribunal.

The HSE decided in 2008 not to apply for the new sanctions.
